Understanding California’s Overtime Laws: Are You Leaving Money on the Table
California workers are entitled to some of the strongest protections in the nation, but navigating the intricacies of California’s overtime laws can be challenging. If you’re not fully informed about your rights, you could be missing out on wages you’ve rightfully earned.
What Are California’s Overtime Laws?
Under California law, most non-exempt employees are entitled to overtime pay for any hours worked over:- 8 hours in a single workday,
- 40 hours in a workweek, or
- 6 consecutive days in a workweek.
- 1.5 times the regular rate of pay for hours worked over 8 in a day or 40 in a week, and
- 2 times the regular rate of pay for hours worked over 12 in a day or over 8 on the seventh consecutive day.
Common Overtime Violations
Unfortunately, some employers fail to comply with California’s overtime laws. Common violations include:- Misclassifying employees as exempt or independent contractors to avoid paying overtime.
- Requiring off-the-clock work, such as unpaid tasks before or after shifts.
- Failing to accurately track hours, leading to underpayment.
- Miscalculating the regular rate, by failing to include bonuses or commissions, shift differentials or premiums, piecework earnings, and other forms of remuneration.
