Were You Required to Keep Your Pay Secret? Or Given Confusing Commission Pay Statements?

A lawsuit challenges two workplace practices affecting Oracle’s sales employees across California.

Secrecy surrounding Sales Comp: The lawsuit challenges Oracle’s confidentiality rules that require sales employees to refrain from discussing their compensation—including commission rates, bonuses, formulas, and pay structures.

Mislabeling “Commission Pay”: The lawsuit also challenges Oracle’s practice of reporting advances on commissions as “Commission Pay” on wage statements and otherwise failing to notify sales employees when their commissions are actually earned.

Trial is set for April 6, 2026.

  • You could not tell when (or if) your commission advances were ever converted to earned commissions, so you could confidently save or spend that money.
  • You had trouble reconciling your pay with Sales Credits, customer payments, or adjustments.
